The terms and conditions below apply to the use of therighttodance.org and The Right to Dance (TRTD) Membership.

By accessing this Website and purchasing a membership you agree to be bound by these Conditions and by the terms of our Privacy Policy (which can be found here). If you do not agree to them, you may not use or access this Website and should leave immediately. You will be asked to tick a box to show that you accept the Conditions and our Privacy Policy before you place an order.

Definitions

"Conditions” means these terms and conditions; 

“Consumer Contracts Regulations” means The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; 

“Product(s)” means the product(s) displayed for sale on the Website; 

“Personal details” means the details provided by you on registration;  

“We/us” means War Child UK, a registered charity in England and Wales (number 1071659) and War Child Trading Limited (Company number 05100189). Both are headquartered at Studio 320, Highgate Studios, 53 – 79 Highgate Road, London, NW5 1TL. War Child Trading Limited is a wholly owned subsidiary of War Child UK and trades only to raise funds for its parent charity's charitable objectives. 

“TRTD” means The Right To Dance

“You” means a user of this Website; 

“Website” means the website located at ww.warchild.org.uk/wintershop or any subsequent URL which may replace it; and 

“UK” means England, Wales, Scotland and Northern Ireland. 

These Conditions do not affect your statutory rights. 

  

TRTD  is providing an opportunity for TRTD Subscribers worldwide to make financial contributions to War Child UK through a fundraising initiative to support our work with children affected by conflict through a monthly membership. 

TRTD Subscribers will receive TRTD Benefits in exchange for their support contributions through a monthly membership. These Benefits include discounts on merchandise and partner products, exclusive mixes and a regular TRTD newsletter. These Benefits are subject to change based on the feedback we receive from TRTD Supporters and what is or isn’t allowed within the constraints of War Child UK’s Safeguarding Policy.

Income generated TRTD Membership Feed will fund War Child’s work with children affected by conflict.

These Terms and Conditions govern the relationship between TRTD and each Supporter, including the terms on which Subscriber contributions may be accepted, refused, or returned by TRTD. TRTD Subscriber contributions will be accepted in the form of an annual payment, or recurring monthly payments made directly to TRTD.

 

1. Agreement

By making a contribution, a TRTD Supporter agrees and acknowledges that:

The contribution is provided to TRTD as an irrevocable fee. The contribution will be used by TRTD to support War Child UK and its charitable activities The contribution is made subject to these Terms and Conditions, which shall constitute a legally binding agreement between the Subscriber and TRTD.

 

2. Monthly contribution payments

You agree to pay your selected contribution amount on a rolling monthly basis.

Payment for your recurring contribution can be made by credit or debit card, or by ApplePay.

By purchasing a Monthly Subscription, you agree to an initial and recurring Monthly Subscription fee at the then-current Monthly Subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription via the My profile section of the site. You may cancel your monthly subscription at any time, subject to the terms of our cancellation policy. Your payment may also be cancelled by TRTD as outlined in section 6 (Refunds and Cancellations) section.

 

3. Annual contribution payments

You agree to pay your selected contribution amount in a one-off yearly basis.

Payments for annual contributions can be made by credit or debit card, or by ApplePay.

By purchasing an Annual Subscription, you agree to an initial pre-payment for one full year of service. After one year and annually thereafter, you will be billed a recurring Annual Subscription fee at the then-current Annual Subscription rate. We will notify you before the renewal fee is billed. You may cancel your Annual Subscription anytime via the My Profile section of the site before the next billing cycle, subject to the terms of our cancellation policy. Your payment may also be cancelled by TRTD as outlined in section 6 (Refunds and Cancellations) section.

If we do not receive payment from your card provider or if your card expires or is rejected, you agree to pay all amounts due upon demand. Following any such non-payment, we may require you to provide a second valid credit card before continuing to use the services. You authorise us to charge outstanding fees due us against any card you have on file with us. We reserve the right to take all steps necessary to collect amounts due from you, including but not limited to legal action.

 

4. Conditions

Contributions will be accepted from individuals as well as any other legal entities.

Contributors who are individuals must be aged 18 or over.

 

5. Administration of contributions

Each membership will be individually refundable, and will be accounted for separately by TRTD. From the moment the membership is processed, TRTD will be legally and beneficially entitled to the full amount of the contribution.

 

6. Refunds and cancellation of contributions

TRTD reserves the right to refuse and return any contribution if we believe that accepting the contribution would conflict with the mission, values or interests of TRTD. 

Any refused contributions will be repaid into the account from which the contribution was made.

You may cancel your Monthly Subscription at any time by logging into your account, clicking on My Account and following the cancelation procedures described there. TRTD members will not receive a refund for the current subscription month.

Cancellation Policy for Annual Subscription Renewals: Annual Subscription fees are non-refundable. You may cancel your Annual Subscription renewal at any time after you are billed for the then-current year and before you are billed for the next year, by logging into your account, clicking on My Account and following the cancelation procedures described there. 

Cancellation is effective immediately upon completing the cancellation process, which means that after you cancel your membership you will not be sent additional TRTD newsletters or have access to the discounts and events on our site during the next billing period. You will, however, be permitted to keep the Products that are already in your possession for the remaining portion of the membership period for which you have already been billed as well as any tickets purchased within that period.

 

7. Data protection and privacy

If you are a TRTD subscriber we will process your personal data in order to provide you with the benefits you are entitled to as part of your subscription. This will include your name, age, contact details, the amount you pay each month or year, your communication preferences and which benefits you choose to make use of. This data will be stored in our secure systems and may also be used, in aggregated form with other individuals’ data, to build profiles of our supporters in order to better understand what may be of interest and how we can communicate effectively with you. 

We will also retain information about your subscription for our records and to analyse the effectiveness of our programmes. 

Your data may be shared with a supplier, such as a ticketing agency or our merchandise store, if it is necessary to fulfil a benefit that you choose to take up. Suppliers may also collect your personal data when you redeem benefits with them. Please see the privacy policy for each company for more information about how they will use your information. We will never sell or share your information for a third party’s marketing purposes.

9. Exclusion of liability

Neither TRTD, War Child UK nor any affiliated person, employee, agent, officer or director shall be liable for any loss suffered by any TRTD Supporter or other person arising out of or in connection with a contribution to TRTD Supporters, whether direct or indirect, including loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, except in respect of any liability for death or personal injury or any other liability which cannot be excluded or limited under applicable law.
